In March 2015, a Cook County jury awarded $25.9 million dollars to the passenger of a Yellow Cab whose driver lost control of his vehicle when attempting to exit the highway. The verdict is significant not only because of its size, but the fact that the jury found against Yellow Cab Affiliation, not just the driver who the cab company claimed was an independent contractor. The attorneys for the injured passenger argued that the cab driver was the “apparent agent” of Yellow Cab Affiliation and therefore, Yellow Cab was liable for the driver’s negligence despite an independent contractor agreement with the driver. Yellow Cab Affiliation promptly filed for bankruptcy protection following the adverse verdict. The verdict is being appealed by Yellow Cab.
